NYS Drug and Alcohol Testing

Overview of Law
Although employers in New York may test their employees and applicants for drugs, they may not use a positive test result as the sole factor in an employment decision unless the employee has a safety-sensitive job or the employer is required by law to discharge the employee.
In addition, employers must use a reputable laboratory for testing. If an employee tests positive, the employee must be allowed to take another test from a laboratory they select.
Employers in New York may not discharge or discriminate against an employee or applicant because of their legal use of consumable products outside of work or their legal recreational activities outside of work.
