Overview of Law
Most employers in New York must allow their employees to have at least 24 consecutive hours off from work every calendar week. Certain exceptions apply, such as dairies that have fewer than eight employees, certain resorts, and employees who care for live animals. An employer may apply for an exemption from the Labor Commissioner.
Before operating on Sunday, employers must notify each employee which day of the week they have for their day of rest. Unless otherwise exempted, employees may not work on their rest day.
Note: Under federal law, employers that have 15 or more employees must reasonably accommodate their employees’ sincerely held religious beliefs.
