Employees who are required or permitted to report for work must be paid for at least four hours, or the number of hours in the regularly scheduled shift, whichever is less. Employees in the hospitality industry must be paid for three hours, or their regularly scheduled shift, whichever is less. The unworked time may be paid at minimum wage. A regularly scheduled shift is one that happens at least once per pay period.
For instance, if an employee comes in for a weekly 2-hour staff meeting, which happens twice per bi-weekly pay period, they can be paid for only two hours because the shift is "regularly scheduled". In contrast, a monthly 2-hour staff meeting, occurring every other pay period, would not be considered "regularly scheduled". As a result, the employee would need to be paid for two hours at their regular rate and two hours at minimum wage.
