Change to EEO-1 report is now blocked

The Office of Management and Budget (OMB) has delayed implementation of the new wage and hour components of the EEO-1 Report, indefinitely. The OMB said the main reason for this decision is because it needs more time to review the burden this report places on employers - in comparison to how effective the new aspects of the report are.

Rationale

Furthermore, OMB stated concerns that, "some aspects of the revised collection of information lack practical utility, are unnecessarily burdensome, and do not adequately address privacy and confidentiality issues" in a letter this week to Acting EEOC Chair Victoria Lipnic.

Petition to reconsider

A petition to reconsider the EEO-1 Report has been pending with OMB for months. Ms. Lipnic requested the OMB make a decision by the end of August - so employers could know whether or not they'd need to prepare for the report or not. And also so the matter could be resolved before the government's fiscal year ends on September 30th.
 

What's staying the same

OMB authorized EEOC to continue using the EEO-1 Report form that has been used in previous years. Some changes will proceed: the report for 2017 will be due March 31, 2018, and the payroll period to be reported must be between October 1, 2017, and December 31, 2017.
